USDA APHIS Deregulates Genetically Engineered Marigold With Red Flowers

October 28, 2026

The U.S. Department of Agriculture's (USDA) Animal and Plant Health Inspection Service (APHIS) has deregulated a genetically engineered African marigold (Tagetes erecta) event pBALL123-022-BE113 developed by Ball Horticultural Company to produce red flower petals. The decision allows the variety to move beyond the regulatory requirements that apply to certain genetically engineered organisms.

USDA APHIS reviewed data submitted by the company, available scientific evidence, and public comments received following the release of its draft plant pest risk assessment in February 2026. The assessment evaluated whether the modified marigold could pose a greater plant pest risk than its unmodified counterpart.

Based on its review, APHIS determined that the engineered marigold is unlikely to pose a greater plant pest risk than conventional varieties, supporting its decision to grant the plant nonregulated status. The agency published its determination, risk assessment, and responses to public comments on October 14, 2026.
